Rules & Regulations

(As approved at an Annual General Meeting on XXXXXXXXXXXX)

 

Definitions:

 

In these rules:-

 

          'The Club' shall mean the Wicklow Sailing Club

 

          The male gender where used herein shall be taken to include the male and female gender.

 

          'The Committee' means the Committee elected under Article 15 hereof.

 

 

1. Title of Club

 

          The Club shall be called the Wicklow Sailing Club

 

2.  Objects

 

(a)      The objects of the Club are to promote yacht racing and boating, watersports and sports activities generally

(b)      The Club shall be affiliated to the Irish Sailing Association and other such National sports authorities as the Committee may from time to time deem fit.

 

3.  Burgee

 

The Burgee shall be white and blue, divided vertically, having a castle upon the white at the hoist.

 

4.  Membership

 

(a)      The club shall consist of Life Members and Senior Members. (Adult members of a family membership shall be deemed a senior member).[PAS1] 

 

(b)      The Club may in addition have the following classes of membership:

          (i)       Honorary Members, see Section 6.

          (ii)      Student Members, i.e. persons over the age of 18 on 1st January of the current year and in full-time attendance at an educational establishment paying a reduced membership fee of 40% of the full senior rate to the nearest €5.00.  [PAS2] , .

          (iii)     Junior Members, see Section 8. (a)

          (iv)      Crew Members, i.e. persons proposed for membership by a boat-owning member and seconded by a committee member, paying a reduced fee of 40% of the full family rate to the nearest €5.00 for a period of not more than two years.

          (v)      Visiting Members, see section 6

(vi)           Family Members, i.e.parents and/or guardians and their children under the age of 18 years on 1st January of the current year

(vii)          Associate/Social members Persons proposed and seconded for membership by members referred to in article 4(a) and upon election have the use of the clubhouse and its facilities.  This category of membership does not extend to any on the water activity or facilities or equipment for same and shall pay a reduced membership of 20% of the full family membership rate (to the nearest €5.00).

 

(c)      Only Members referred to at Article 4 (a) and 4(b) (ii) , shall be voting members of the Club, allowed a vote at annual and special general meetings of the Club and be eligible for election as officers of the Club.

 

(d)      Other categories of member may be eligible to be members of sub committees with such voting rights as may be allocated by the Committee.

 

(e)      The Committee may at its discretion enter into an agreement with any other bona fide Sports Club whether in Ireland or elsewhere for reciprocal membership and on the signing of any such Agreement the fully paid up members of each club being party to the agreement shall be deemed to be full members of the other club but without any voting rights in such other club.

 

5.  Election of Members

 

(a)      The election of members shall be at the discretion of the Committee, which shall not elect any such members until a period of at least two weeks has elapsed from the date of nomination,

 

(b)      Candidates for membership shall be proposed and seconded by members referred to in article 4(a) who have been Members for at least one year and in good standing with the Committee. (Good standing shall mean current year's subscription paid and not under any suspension)

 

(c)      The Entrance Fee, if any, and Annual Subscription must be lodged with nomination,

 

(d)      The names and addresses of persons proposed as members shall be displayed on the Club notice board in the Club premises for at least two weeks prior to election,

 

(e)      Members who have been members for a minimum of eight years, are aged 65 or over and who have retired from business and/or employment may apply in writing to the Committee to continue their membership at a reduced fee being 60% of their normal full rate.

 

6.  Honorary Members and Visiting Members

 

(a)      The Committee may at its discretion elect a person that it considers fit and proper to be an Honorary Member or an Honorary Life Member, subject to the following provisos:-

 

          (1)        Elections shall be subject to ratification by the next Annual General Meeting,

 

          (2)        Not more than six Honorary Members shall be elected in any one year,

 

(3)                 The number of Honorary Members shall not exceed ten at any time.

 

          (4)        The duration of an Honorary Membership is at the discretion of the Committee

 

(b)      In addition to the foregoing, the Committee may also elect members of other bona fide Clubs as temporary Honorary Members for a period not exceeding twenty-one  days provided that any person applying for election as a member of the Club under this rule shall establish to the satisfaction of the Committee that such membership is required and necessary so that proposed Honorary Member may take part in the sporting activities of the Club,

 

(c)      Visiting Membership may also be conferred upon any person bona fide resorting to the Club in consequence of participation in any of the sports or sporting activities provided by the Club. The conditions of such membership shall be determined by the Committee and may include the payment of a membership subscription on a daily or weekly basis.

 

7.  Limitation of club Liability

 

“Members their guests and visitors are bound by the following rule which shall also be exhibited in a prominent place in the Club Premises:-

 

“Members of the Club, their guests and visitors use the Club premises, and any other facilities of the Club, entirely at their own risk. It is a condition of entry that members, guests and visitors agree that:-

 

          (i)      The Club shall not be liable for any damage to or loss of property belonging to members, their guests or visitors to the Club.

 

          (ii)     The Club shall not be liable for any personal injury arising out of the use of the Club premises or any facilities of the Club either sustained by members, their guests or visitors or caused by the said members, guests or visitors whether or not such damage or injury could have been attributed to however occasioned by the neglect, default or negligence of any of them the Officers, Committee or servants of the Club."

 

 

8.  Junior Section

 

(a)      The Junior section shall consist both of members under the age of eighteen years on 1st. January of the current year who have been elected as Junior Members by the Committee, and shall pay a reduced membership fee being 20% of the normal family rate to the nearest €5.00, and children who are members by way of article 4(b)(vi)

 

(b)      The affairs of the Junior section shall be controlled by the Committee,

 

(c)      Junior Members shall elect one of their number to act as chairman of the Junior section and liaise with the main Committee,

 

9. Resignations

 

Any member may resign from the club and, in which case, shall, before the date of the Annual General Meeting, signify their intention in writing to the Honorary Secretary.

 

10. Expulsion or Disciplining  of a Member

 

(a)      A general meeting of members may by a special resolution expel any member from membership of the Club. Voting at such General Meeting shall be taken by Secret Ballot.  Unless otherwise resolved by the members, the member concerned shall, as and from the date of such resolution, cease to be a member of the Club.

 

(b)      No resolution under this Article shall be put to a general meeting, unless the same shall have been proposed and seconded in writing and forwarded to the Honorary Secretary not less than 6 weeks before such meeting and that not less than 4 weeks notice of the proposal to expel a member is given to the members.  The notice to members shall include a copy of the proposed resolution and any written material upon which it is  based.

 

(c)      If the conduct of any member is or has been in the opinion of the Committee injurious to the interests or character of the Club or is or has been such as to render him in the opinion of the Committee unfit to continue to be a member of the Club the Committee may consider the suspension of a member from membership of the Club.

 

(d)      The Committee shall consider the conduct of a member under this article upon receipt of the signed complaint of not less than 21 members, specifying grounds upon which such complaint is made.

 

(e)      Before considering the suspension of a member under this rule the Committee shall forward to such member:

          (i)            a statement of the grounds upon which it is proposed to consider his suspension

          (ii)           all written material before the Committee bearing upon the conduct of the member

          (iii)           an invitation to appear before the committee and/or to submit in writing or otherwise such representations as the member may wish.

 

(f)       Upon the consideration of the matter the Committee may suspend the member concerned from membership or from any particular privilege or privileges of membership for such period or periods of time as the Committee consider right.

 

(g)      No decision shall be taken by the Committee in relation to the suspension of a member unless 7 clear days notice is given to each member of the Committee that such suspension is to be considered and that each Committee member is furnished at the same time with a copy of the material at 9(e)

 

(h)      Any member so suspended shall have the right to request a Special General Meeting of the Club to consider his membership.   A member calling for such a meeting shall give Notice in writing of his request to the Honorary Secretary.  Such Notice shall be given within 3 weeks of the Notification  to him of his suspension.

 

 (i)      It shall be the duty of the Committee to convene such a Special General Meeting for the exclusive purpose of considering and determining upon the question of the expulsion of such Member.  Such meeting shall be convened in accordance with Article 10(a).

 

11. Subscriptions and Fees

 

(a)      The members in general meeting may fix an Entrance Fee in respect of any class or classes of member.

 

(b)      The Annual Subscriptions shall be payable in advance and be due on 1st. January each year,

 

(c)     The Entrance Fee and Annual Subscription shall be as determined by members at the Annual General Meeting from time to time,

(d)     The annual subscription for Senior Members will be determined to be  75% (to the nearest €5.00) of the normal family rate.

(e)     Members in categories 4(a) whose subscription is paid up in full before 31st March shall be entitled to a 10% reduction on their annual subscription.

 

 

 

12. Penalties For Non-Payment  of Subscriptions.

 

(a)      Members whose Subscriptions are not paid by 31st. March of the current year shall cease to be entitled to membership,

 

(b)      Members whose subscriptions are in arrears shall not be allowed to take part in any proceedings of the Club or to enter as owner or part-owner or steer a yacht for any prize given by the Club until such arrears are paid,

 

(c)      A Member whose membership has ceased under Rule 12(a) may be re-entered on the Register of Members on payment of his appropriate annual subscription and upon such terms as are fixed by the Committee.

 

(d)      A former member who has not applied for reinstatement before the annual general meeting shall not be elegible to do so but may apply to become a member in accordance with Rule 5

 

13. Accounts

 

Correct Accounts and books shall be kept showing the Financial affairs and receipts and disbursements of the Club. It shall be the duty of the Honorary Treasurer to ensure that these books are properly kept and written up to date. Annual accounts shall be maintained and made available to the Revenue Commissioners on request.

The Honorary Treasurer shall submit to the Annual General Meeting his accounts for the preceding year and the accuracy thereof  shall be certified by either the Commodore or by an Honorary Auditor who shall be elected at the Annual General Meeting, if required.

 

14. Trustees and Borrowing Powers.

 

(a)            There shall be three Trustees, in whom all the property of the Club, both present and future, will vest.  The Trustees shall hold all Club property in trust for and on behalf of the Members and they shall deal with such property as directed by the Committee, or the members in general meeting

 

(b)      The Trustees will hold office during their life-time unless they retire or are removed from office.  The Committee, by a Resolution passed by at least two-thirds  of those present and voting shall have power to remove such Trustees from office and to declare a vacancy,

 

(c)      The Trustees shall be entitled to an indemnity from the Club in respect of all activities carried out as Trustee. Such indemnity does not extend to a Trustee who is also a Committee member.

 

(d)      Any vacancy among the Trustees shall be filled by the election of a new Trustee at the Annual General Meeting next following the creation of the vacancy or at an Extraordinary General Meeting called for that purpose. Nominations for Trustees must be proposed and seconded by voting members. Pending the filling of a vacancy at Annual General Meeting or Special Meeting, the Committee shall have power to appoint a Trustee or Trustees who will hold office until the next Annual General or Special Meeting.

 

(e)      Where a Trustee resigns from or ceases to be a Member of the Club he will be presumed to have retired from the position of Trustee and a vacancy will occur,

 

(f)       The Trustees shall be entitled to attend at meetings of the Committee.

 

(g)      The Committee is empowered to borrow for the purposes of the Club such amounts of money upon such terms and upon such security as the Committee shall think fit and proper up to and not exceeding  20% of the net assets of the club as stated in the annual accounts adopted at the immediately preceding Annual General Meeting of the Club.  All Members of the Club and all persons subsequently becoming Members of the Club shall be deemed to have assented to any borrowing of money authorised by this Rule subject to the foregoing limit and to the giving of security in respect of same, provided that such security shall not exceed the equivalent of one full years subscriptions  paid by members as stated in the annual accounts adopted at the immediately  preceding Annual General Meeting of the Club.

 

(h)      The members of the club by special resolution at a general meeting  may authorize the Committee to borrow money or to give security in excess of the foregoing subsection for any purpose considered at such general meeting.

 

15.  Constitution of Committee

 

(a)      The Committee shall consist of a President, a Commodore; Vice Commodore; Rear Commodore Sailing, Rear Commodore House, an Honorary Treasurer and an Honorary Secretary who shall be the Officers of the Club and up to eight other Members.   Members proposed for election as Officers must have served at least one year on the General Committee.  The Member proposed as Commodore must have served at least one year as an officer of the club with no restriction as to time on the committee. All such officers must be proposed as provided in sub-section (d),

 

(b)      The retiring Commodore shall ex-officio  be a member of the Committee in the year following his retirement.

 

(c)      All ordinary members of the Committee other than officers shall hold office for a term of 2 years or until they resign from office.  Half of the Committee shall retire each year. A Committee member so retiring (after the 2 year period) shall be eligible for re-election.

 

(d)      Flag Officers who have held a post consecutively for the previous three years shall not be eligible for re-election to that post until a further twelve months has elapsed, with the exception of the President. The term of office of the President shall be three consecutive years, but a President so retiring (after the three year period) may stand for re-election for one further three year period.

 

(e)      Vacancies on the Committee shall be filled by election at an annual general meeting, or, in default, the Committee may co-opt at a future date any of the said committee members.

 

(f)       Nominations for positions of Officers of the Club must be proposed and seconded by persons who are members in good standing  and who have been members of the club for a minimum  period of at least one full year such nominations shall be submitted in writing to the Secretary at least three weeks prior to the date of the annual general meeting or in default viva voce at the meeting. A candidate for election as an ordinary member of the Committee must have been a Member of the Club for at least one year and shall be proposed and seconded by members either in writing or viva voce at the Annual General Meeting for that year, or may be co-opted as in 15(e).  Where there are more candidates than there are vacancies election shall he by ballot. Between candidates receiving an equal number of votes the selection shall be decided by lot,

 

(g)      No member who is an undischarged Bankrupt or who has compounded with his creditors in the previous five  years or who has been convicted of a serious offence resulting  in a custodial sentence or who is under a ban from competition bv a national authority to which the club is affiliated or by any other authority which the national authority is bound to uphold, shall be eligible to serve as an Officer or member of the Committee or if so elected shall automatically be disqualified  from office upon notice of any such matter being formally delivered to the Honorary Secretary.  Provided always that such member shall be afforded an opportunity to show that any notice so delivered to the Honorary  Secretary  does not have the effect alleged.  Such  prohibition  is without  prejudice to the rights of the club to forfeit membership  elsewhere in the these rules.

 

(h)      No member of the committee and no manager or servant employed in the Club shall have any personal interest in the sale of excisable liquors therein or in the profits arising from such sale.

 

(i)       The Committee shall meet to conduct the business of the Club at least once every month

 

(j)       (1)           At the ballot for the election of Officers and Committee members, a statement shall be given to members of the number of Committee meetings held during the previous year,

 

          (2)           Where members standing for election are members of the out-going Committee, whether Officers, or otherwise, the statement shall in addition, state the number of Committee meetings actually attended by such member during the preceding year.

 

16. Powers of the Committee

 

(a)      The business and affairs of the Club shall be under the exclusive management of the Committee which shall have the general power and authority necessary to discharge its task efficiently,

 

(b)      The Committee shall, without limiting the generality of clause 16(a) and in particular without limiting its own responsibilities and duties, have powers to:

 

          (1)           Make sailing and other regulations,

 

          (2)           Fill by co-option any vacancy that occurs on the Committee, occurring during the currency of any year and more than one month before an annual general meeting.  Any such time served as a committee member as a result of such co-option shall not be reckoned as part of the time for any period for which membership of the committee is required in any other part of these rules.

 

          (3)           Appoint from members of the Club a person or persons to take charge of such duties as the Committee deems advisable and for such time as the Committee may determine,

 

          (4)           Appoint such sub-committees as it may deem necessary or expedient and to depute or refer to them such matters or such of the powers and duties of the Committee as it may determine. Such sub-committees shall be responsible to the Committee which may terminate their appointment at any time. The composition of such sub-committees need not be confined to members of the Committee,

 

17. General and Special Meetings

 

(a)      The Annual General Meeting shall be held not later than 30th November in each year,

 

(b)      The Honorary Secretary shall at any time by notice describing the object of such meeting, summon a 'Special General Meeting' on a resolution of the Committee or on receipt of a requisition signed by at least 21 Senior Members.  Such meeting shall be held as soon as is practicable after the receipt of such resolution or requisition.

 

(c)      4 weeks notice shall be given of Annual or Special General Meetings.

 

(d)      Notice of motions to be submitted at the Annual General Meeting must be lodged with the Honorary Secretary not less than three weeks before the meeting. Any such notices will be posted on the Club Notice-Board not less than two weeks before the meeting.

 

(e)      A simple majority of those present and voting shall be required to transact any business at any general meeting, save where in these rules a special resolution is required, in which case a majority of one third or more of those present and voting shall be required to carry the resolution.

 

(f)       Only members of  good standing and categorized in Article 4(a), 4(b)(i), 4(b)(ii), 4(b)(iv), 4(b)(vii) may attend the Annual General Meeting or a special General meeting.  This rule does not supercede article 4(c).

 

18.  Quorum

 

Twenty one members shall form a quorum at a General or Special Meeting and five Committee Members shall form a Quorum at a Committee meting.

 

19.  Rules

 

(a)      The Committee shall be the sole authority for the interpretation of these Rules and any of the regulations made thereunder and its decision shall be final and binding on the Members,

 

(b)      No alteration of or addition to, these Rules shall be made save at the Annual General Meeting or at a Special General Meeting expressly convened for that purpose, except as in sub-section (d) below and in Article 22 sub-section (b).[PAS3]  A special resolution shall be required to effect any such change.

 

(c)      No additions or alterations shall be made except with the prior approval of the Revenue Commissioners.  Any resolution duly passed  purporting  to alter these rules shall be of no effect until the approval of the Revenue Commissioners shall have been obtained.  Upon receipt of such approval the resolution shall have effect as and from the date of its passing

 

(d)      The Committee shall have the power to amend the Rules relating to the sale of Excisable Liquor (Rule 21) for the purpose of complying with the Registration of Clubs Act 1904 and any amendment thereof

 

20.   Dissolution of the Club

 

      If upon the winding up or dissolution of the club there remains after the satisfaction of all debts and liabilities any property whatsoever the same shall not be paid or distributed amongst the members of the club but shall be given or transferred to some other sporting institution or institutions  having main objects similar to the main objects of the club and which institution or institutions having rules that prohibits the distribution of its or their income or property among its or their members to an extent as lease as great as that imposed by this rule upon the club, such institution or institutions to be determined by the members of the club at or before the winding up or dissolution and if and in so far as effect cannot be given to this provision then to some charitable object.

 

21 Rules Relating of the Sale of Excisable Liquor

 

     The statutory Provisions contained in the Registration of Clubs Acts 1904 to 2000 or any further amendment or substitution thereof, insofar as the same relate to the provisions required to be incorporated in these Rules for the purpose of complying with the said Acts, shall be deemed to be a part of these Rules.

 

Schedule 1: Rules Relating of the Sale of Excisable Liquor

 

     The sale of excisable liquor in or from the Club premises shall be subject to the provisions of the Registration of Clubs Acts, 1904 to 2000 and the provisions of the Licensing Acts 1833 to 2000 and per the provisions of any amendments to the foregoing Acts and per the provisions of any other applicable legislation.

 

1.       (a)      A book (hereinafter called the Visitors Book) shall be kept at all times on the club premises.

          (b)      No visitor to the club shall be supplied with excisable liquor in the club premises unless on the invitation of and in the company of a Member.

          (c )     Any Member bringing a visitor to the Club shall upon the admission of such visitor to the Club premises or immediately upon his being supplied with liquor, enter his own name and the name and address of the visitor in the Visitor's Book and the date of each visit shall be entered in the Book in addition.  A Member may only introduce two visitors at any one time and may not introduce the same visitor more than twice in any one year. No visitor shall remain on the club premises after the Member introducing him has left.

          Notwithstanding the provisions of (b) and (c) foregoing, in the event of a group visiting the Club as envisaged in Section 30 of the Intoxicating Liquor Act 2000, the provisions of the said Section 30 shall apply.

          (d)      No excisable liquor shall be sold or supplied to any person under eighteen years of age.

 

Schedule 2

 

The following Extracts are Sections from the Intoxicating Liquor Act 2000:

 

Amendment of Section 2 (prohibited hours) of Act of 1927:

 

3-       Section 2 (as substituted by section 25 of the Act of 1988 and amended by Section 2 of the Act of 1995) of the Act of 1927 as amended by the substitution of the following subsections for subsections (1):

"(1) Save as otherwise provided by this Act, it shall not be lawful for any person to sell or expose for sale any intoxicating liquor, or to open or keep open any premises for the sale of intoxicating liquor, or to permit any intoxicating liquor to be consumed on licensed premises-

    a)   at any time on Christmas Day or Good Friday:

    b)   on any other day, as specified hereunder, outside the times so specified in respect of it

          (i)       Saint Patrick's Day: between 12.30p.m. and 12.30 a.m. on the following day;

          (ii)     the 23rd December: if it falls on a Sunday, between 10.30 a.m. and 11.30 p.m.;

          (iii)    Christmas Eve and the eve of Good Friday: between 10.30 a.m. and 11.30 p.m.

          (iv)      the eve of any public holiday (other than Christmas Eve):

                        (1)         if the eve falls on a weekday, between 10.30 a.m. and 12.30 a.m. on the following day, or

(2) if it falls on a Sunday), between 12.30 p.m. and 12.30 a.m. on the following day

          (v)      any other Sunday (except a Saint Patrick's Day which falls on a Sunday): between 12.30 p.m. and 11.00 p.m.;

          (vi)      any other Monday, Tuesday, or Wednesday: between 10.30 a.m. and 11.30 p.m.; and

          (vii)     any other Thursday, Friday or Saturday:

          between 10.30 a.m. and 12.30 a.m. on the following day.

 

(1A) The hours specified in paragraph (b) of subsection (1) in respect of any day specified in that paragraph are in addition to the period between midnight and 12.30 a.m. on that day where that period is included in the hours so specified in respect of the eve of that day.

 

(lB) In subsection (1), 'public holiday' has the meaning given to it by the Organisation of Working Time Act 1997."

 

Amendment of Section 56 (prohibited hours in Clubs) of Act of 1927

 

7-       The Act of 1927 is amended by the substitution of the following for section 56 (as substituted by section 26 of the Act of 1988 and amended by section 5 of the Act of 1995):

 

"56 - (1) In order that a club may be eligible to be registered under the Registration of Clubs Acts, 1904 to 1999, the rules of the club shall (in addition to the matters mentioned in section 4 of the Registration of Clubs (Ireland) Act 1904) provide that subject to the exceptions specified in subsections (2) and (3) of this Section, no excisable liquor shall be supplied for consumption on the club premises to any person (other than a member of the club lodging in the Club premises) or be consumed on those premises by any person (other than such a member)-

(a)   at any time on Christmas Day or Good Friday, or

(b)   on any other day, outside the hours specified in respect of that day in section 2 (1) (b) (as substituted by section 3 of the Intoxicating Liquor Act, 2000) of this Act.

 

          (2) Nothing in the Registration of Clubs Acts, 1904 to 1999, or contained, by virtue only of the operation of subsection (1) of this section, in the rules of a club registered under those Acts shall operate to prohibit the supplying for consumption on the club premises of excisable liquor to any person or the consumption of excisable liquor on those premises by any person

(a)   on Christmas Day between 12.00 midday and 10.00  p.m. or

(b)   on any other day, for one hour after the expiration of any period in respect of that day during which it is lawful for the club, by virtue of subsection (1) (b), to supply any excisable liquor for consumption on the club premises,

 

If in each case the excisable liquor is

(i) ordered by or on behalf of that person at the same time as a substantial meal is so ordered, and

(ii) consumed by that person during the meal or after the meal has ended.

 

(3)      (a) For the purposes of the Registration of Clubs Acts, 1904 to 1999, the rules of a club which at the commencement of section 7 of the Intoxicating Liquor Act, 2000, is registered under those Acts, shall, during the transitional period, be deemed to be in conformity with this section.

(b) In this subsection 'transitional period' means the period beginning at such commencement and ending

                   (i)  when the certificate of registration of the club which is in force two months after that date expires, or

                   (ii)  when the rules of the club are brought into conformity with this section.

whichever first occurs".

 

Amendment of Section 7 (drinking up time) of Act of 1962

 

8- Section 7 (drinking up time) of the Act of 1962 is amended by the substitution -

 

          (a) in subsection (1) (b),of "(other than sections 2 and 5 of the Act of 1927)" for "(other than section 2 of the Act of 1927", and

 

          (b) in subsection (2) (b), of "(other than section 21 of the Act of 1924 and subsection (1) of section 56 of the Act of 1927)" for "(other than subsection (1) of section 56 of the Act of 1927)".

 

Further amendment of Act 1988

 

"Display of Notice”

 

15- Part IV of the Act of 1988 is amended by the insertion of the following section after section 41:

 

41A.:

 

(1)      The holder of a licence in respect of licensed premises and the secretary of a club registered under the Registration of Clubs Acts, 1904 to 2000, shall display in a conspicuous place in the licensed premises or club premises concerned a notice containing a statement of the offences provided for in this Part.

 

(2)      The notice shall be in a form or forms prescribed by regulations made by the Minister.

 

(3)      A person who contravenes subsection (1) shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding -

 

     (a)   £250.00 (€317.50) in the case of a first offence, or

 

     (b) £500.00 (€635.00) in the case of a second or any subsequent offence.

 

(4)      Regulations under this section shall be laid before each House of the Oireachtas as soon as practicable after they are made and, if a resolution annulling the regulations is passed by either such House within the next 21 days on which that House has sat after the regulations are laid before it the regulations shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.

 

(5)      The provisions (relating to the display of notices) of subsections (4) and (6) of section 34 and subsections (3) and (6) of sections 35 and 36 are repealed.

 

(6)      This section shall come into operation on such day as the Minister may by order appoint".

 

Application to registered clubs of provisions of Act of 1988 relating to under age persons

16- Sections 31, 32, 33, 34, 35 and 36A (inserted by this Act) of the Act of 1988 shall apply in relation to a club registered under the Registration of Clubs acts, 1904 to 2000, as if any references in those provisions to the holder of a licence and to licensed premises were references to the secretary of such a club and to that club's premises and with any other necessary modifications.

 

Groups visiting registered clubs

 

30 - (1) where members of a group are visiting a registered club for the purpose of -

                   (a)      taking part in any pastime, sport game or recreation there, or

                   (b)      organising or taking part in the organisation of, or arrangements for, any such activity,

 

          intoxicating liquor may be supplied to them at the request and in the presence of an official of the registered club on the occasion of the visit.

 

          (2) An official of the registered club being visited shall enter the name of the group concerned, and the number of persons in it in the book required to be kept by paragraph (g) of section 4 of the act of 1904.

 

          (3) This section shall have effect notwithstanding anything in the said paragraph (g) or any rule required to be made by a registered club under it.

 

          (4) In this section "group" means a club (whether registered or unregistered), society or organisation.

 

22 [PAS4]         Rules Relating to the Tobacco Smoking (Prohibition) Regulations 2003

 

(a) The smoking of tobacco products in the club premises is prohibited,
in accordance with the Tobacco Smoking (Prohibition) Regulations 2003 (S.I.
481 of 2003) or any amendment thereof.


(b) The Committee of the Club shall have the power, by resolution, to amend
this rule from time to time, as required, to ensure that the Club rules
comply with any enactment or order made in relation to paragraph (a).

 


 

 

Regulations

Made by the Committee of Wicklow Sailing Club under Rule 16.

 

1. In considering whether to affiliate to any national sporting body the Committee shall be limited to considering the benefits and welfare of the Members of the Wicklow Sailing Club.

 

2. In considering whether to appoint a person other than a Member under Rule 4 (a) to a sub- Committee the Committee shall have regard to the requirements that the affairs of the Club, including those delegated to a sub-Committee shall be under the control of persons who are Members under Rule 4 (a).

 

3. In considering whether to enter into reciprocal arrangements with another sports Club under Rule 4 (e) the Committee shall be limited to considering the benefits and welfare of the Members of the Wicklow Sailing Club.

 

4. The Committee shall be empowered to grant a reduction in subscription to persons who are Members of the same family, whether of the same class of Membership or not and may at its discretion grant a reduction in subscription to persons to whom for personal reasons the full subscription would be a burden.

 

5. The Committee may elect to Associate Membership (Associate/Social Member for a fee of 50% of Senior Member)[PAS5]  such persons who are eligible for Senior Membership but who for reasons appearing sufficient to the Committee are not in a position to avail of the full benefits of Membership.

 

6. Members who have been full Members for a minimum of eight years, are aged 65 or over and who have retired from business and/or employment may apply in writing to the Committee to continue their membership at a reduced fee being 60% of their normal full rate.

 

7. A Member who has reached the age of 70 years and has been a full member of the Club for twenty years next preceding his or her 70th Birthday shall be entitled to become a life member. The Committee shall elect a member so qualifying to be a Life Member, unless the Committee decide otherwise and notify the member in writing the reason for its decision.

 

8. In exercising its functions under Rule 5(a), considering those persons proposed for election as Members of the Club, the Committee shall consider, at a meeting held for the purpose of considering any such application, the representations, if any, made to it by members concerning a person nominated for membership.

 

9. In considering whether to elect a person to Associate Membership the Committee shall have regard to whether such a person has a bona fide interest in the affairs of the Club but for reasons which appear to the Committee is not at that time in a position to avail of the Club’s facilities. Any such person who having being an Associate Member ceases to qualify shall be so informed by the Honorary Secretary and shall thereupon become eligible to be a full Member and on being so informed shall cease to be an Associate Member.

 

10. In considering persons to be elected as Honorary Members or Honorary Life Members, the Committee shall elect only such persons who have by service or in some other manner been distinguished in the opinion of the Committee such that the Membership of that person is considered an asset to the Club.

 

11. At a meeting called for the purpose, or at which the disciplining of a Member is to be considered, the Committee shall consider any representations whether made in person to the Committee or in writing by any Member.

 

12. The Committee should only exercise its powers to borrow funds for the purposes of the Club where such borrowing is of a minor or a strictly temporary nature. Any borrowing requirement greater than the total of the annual subscription income in the most recent financial year should be submitted for approval to an annual or special general meeting of the Club.

 

13. Meetings of the Committee

 

         (a) The Committee shall keep minutes of its meetings, which shall be circulated to  Members of the Committee prior to each meeting.

         (b) Such minutes of Committee meetings shall be kept by the Honorary Secretary and  shall be available for inspection by Members on request.

         (c) Notice of Committee meetings shall be given to Members of the Committee at least 7  days in advance of such meetings, save in an emergency.

         (d) In the case of an emergency meeting, necessitating less than 7 days notice to Committee Members, only that business which is of an urgent nature shall be transacted.

 

14.Races

 

         (a) The racing season shall commence not later than the first Sunday in May and shall continue to a Sunday in September to be named from year to year by the Committee,

         (b) The races will be sailed under IYR Rules and ISA prescriptions except as specifically varied in accordance with the Sailing Regulations and the programme laid down by the Committee.

 

15. Trophies

 

All Perpetual Cups and Trophies won must be returned to the Rear Commodore - Sail not later than 31st. October each year,

 

16. Regulations made by the Committee shall be made or altered by a resolution of the Committee passed by a majority of one third of those present and voting. Notice of the passing of any such resolution shall be posted on the Club Notice Board. Any resolution for the making of a Regulation or the amendment of any regulation shall not come into effect until 21 days after it shall have been posted on the Notice Board. If within the said period of 21 days notice shall have been received calling for a Special General Meeting to consider the regulation or alteration, the regulation or alteration shall not come into effect unless and until the decision of the General Meeting so called is made known. In considering a new regulation or amendment, a General Meeting may by a simple majority approve or disapprove of the proposed regulation or amendment. The General Meeting may by a majority of one third of those attending and voting amend any proposed regulation. A regulation thus amended shall be deemed to be passed.
